TERMS AND CONDITIONS OF HIRE

1.1  This is a contract covering the hire of bicycles and associated equipment (“the Equipment”) and will be governed by English law.

1.2  The parties to the contract are:

        (i) the person named on the hire agreement overleaf (“the Hirer”)

        (ii) Simon Ford trading as ‘Go Pedal’ (“the Owner”)

2.1  Charges, a deposit and the period of hire are as set out on the hire agreement.  In the event that the Equipment is not returned to the Owner by the agreed time, the Owner reserves the right to withhold all or part of the deposit*.

3.1 The Equipment remains the property of the Owner, and the Hirer will not sell, hire, lend or otherwise part with possession thereof.

3.2  The Hirer accepts total responsibility for the safety and conduct of those using the Equipment hired under this contract.  In particular the Hirer acknowledges that the Owner is under no duty to supervise any persons using the Equipment and that the Hirer and such persons are solely responsible for the safety of themselves and of the Equipment.

3.3  The Hirer will ensure that the Equipment is adequately secured to an immovable object when not in use.  In the event that the Equipment is damaged, lost or stolen, the Owner reserves the right to use part or all of the deposit to make necessary repairs or replacement.

3.4  The Hirer must notify the Owner as soon as possible if the Equipment is damaged, lost or stolen.

4.1  In the event that he is informed of a mechanical failure in the Equipment during the period of hire, the Owner will use best endeavours to carry out a repair or replacement.

4.2  Except in respect of death or personal injury caused by the Owner's negligence, the Owner shall not be liable to the Hirer or to other users of the Equipment by reason of any representation, or any implied warranty, condition or other term, or any duty at common law, or under the express terms of this Contract, for any consequential loss or damage (whether for loss of profit or otherwise), costs, expenses or other claims for consequential compensation whatsoever (and whether caused by the negligence of the Owner, its employees or agents or otherwise) which arise out of or in connection with the use or supply of the Equipment, except as expressly provided in these conditions

 *In the event of lost or stolen equipment, charges will be raised as follows:

 Complete bike: £200; helmet: £30; D-lock: £30; wheel: £30; seat: £25; lights: £5 per light; sundry other items at replacement value
